This is fully refundable on return of the equipment, on the agreed date and time, in the same condition as it was let out to you. Your security deposit will be used to fund any loss or damage what so ever to equipment, or its misuse.

 

We reserve the right to collect security deposit from any customer if there is inadequate, adverse or incomplete credit history.

 

 

Availability is on a request and confirm basis at the time of reservation. A reservation is only binding after it has been confirmed by SOS Broadband and if applicable a security deposit has been received. Payment is by credit card, debit cards or cheque in Pounds Sterling.

 

 

Visa card and Mastercard only.

 

 

a. 100% of total hire charge

SOS Broadband Terms of business

 

Definitions of Terms and Conditions 'You', refers jointly and severally to the person or persons or companies who are the customers.' This Agreement' means the Rental Agreement, and these Terms and Conditions. In the event of any discrepancy between these Terms and Conditions and any other SOS Broadband literature, the provisions of these Terms and Conditions apply

 

o 'SOS Broadband '

 

means SOS broadband owned by Filup Limited, 132, Heathfield Road, Keston BR2 6BA, UK

 

o 'Customer'

 

means the person or persons or company or companies nominated in the rental confirmation email and any person or company whose bank account, cheque or credit card is presented in payment of the customer's charges.

 

o 'Rental Period'

 

Means the hire period referred to on the rental confirmation email or any agreed variation thereof and any additional period during which the Equipment is in the customer's possession or control

 

o 'Equipment'

 

Means the SOS broadband modem, cables, software disks and any accessories which may be provided at the discretion of SOS Broadband.

 

o 'Security Deposit'

 

Means the Equipment security deposit detailed under the heading SOS Broadband Equipment hire agreement

 

 

1. Delivery and Return of mobile wireless Equipment

 

The equipment shall be returned in a clean and working condition, on the return date and time set out in the rental confirmation email

 

SOS Broadband will not refund to me any monies, if the equipment is returned or you cease to have the use of the equipment prior to the return date for any reason e.g. Accident, or theft.

 

2. Rental and Other Charges

 

You will pay SOS broadband

 

a. All rental charges

 

b. The security deposit if applicable

 

c. The nominated cancellation fee in the event of cancellation of this agreement prior to acceptance of delivery of the equipment;

 

d. The cost of any damage to the equipment or the property of any third party;

 

e. All government fees and duties etc;

 

f. Any other fees or charges payable by you pursuant to this Agreement. This includes any costs incurred by SOS broadband as a result of any breach by me of the terms of this Agreement

 

3. Payment of Charges Joint and Several Liability

 

All charges and expenses payable by me under this Agreement are due on demand by SOS broadband. If you do not pay all charges when due, you agree to pay a late charge of 1.5% per month on the outstanding balance and any collection costs incurred by SOS broadband, including reasonable legal fees. When the Customer comprises of more than one person, each person is liable jointly and severally for all obligations of the customer pursuant to this Agreement.

 

 

4. Credit Card Payment

 

When payment is paid by credit card, you agree that;

 

SOS broadband is irrevocably authorised to complete any documentation and to take any other action to recover from your credit card issuer all amounts due by you pursuant to this Agreement, including but not limited to, any amounts due in respect to damage to the Equipment and all other additional charges as they are incurred (including associated administration costs);

 

You will not dispute my liability to SOS broadband for any amount due under this agreement and You shall indemnify and keep indemnified SOS broadband against any loss incurred (including legal costs) by reason of notifying Your credit card issuer of such dispute.

 

SOS broadband may process the credit card voucher; in the event that SOS broadband elects to accept payment of the Security Deposit by holding an open security payment which will be cancelled at the completion of the Rental Period, You agree that SOS broadband is entitled to recover payment from Your credit card issuer pursuant to paragraph (1) in respect of any amounts due which were not known at the time of cancelling the open security payment.

 

You acknowledge that all transactions under this agreement are conducted in Pounds Sterling. Due to exchange rate fluctuations, there could be some variance between the amount initially debited against my credit card and the amount refunded within 7 days after the expiration of the rental period. You release SOS broadband from any liability for such variation.

 

5. Your Warranties

 

You warrant that all information supplied by you to SOS broadband in connection with this agreement is true.

 

This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement. SOS broadband reserves the right to add or amend any rental charges without prior notice.

 

 

6. Security Deposit

 

a. You irrevocably authorise SOS broadband to deduct from the Security Deposit any amounts due by you to SOS broadband arising out of this Agreement.

 

b. The security deposit will be refunded by within 3 working days of the equipment being returned to the correct location

 

 

7. Use of the Equipment

 

You agree that during the rental period, You will not and will not allow the Equipment to be;

 

a. Damaged by:

 

b. Submersion in water

 

c. Contact with Salt Water

 

d. used for any illegal purpose

 

e. otherwise used in breach of my obligations under this Agreement.

 

 

8. Alterations to the Equipment

 

You will not make any alterations or additions to the equipment without the prior written consent of SOS broadband

 

 

9. Terminating the Agreement

 

You acknowledge that SOS broadband may terminate this Agreement and repossess the equipment at any time, without notification to you, and that you will pay the reasonable costs of repossessing the equipment if;

 

a. You are in breach of any term of this Agreement;

 

b. You have obtained the equipment through fraud or misrepresentation;

 

c. You equipment appears to be damaged

 

d. You equipment is not returned on the agreed return date or SOS broadband reasonably believes that the equipment will not be returned on the agreed return date;

 

You understand that in the event of such termination or repossession, You have no right to a refund of any part of the rental charges or the Security Deposit

 

10. Change of Equipment

 

SOS broadband reserves the right, at its absolute discretion, to substitute comparable or superior Equipment for the Equipment. In that event, you will not be liable for any increased rental or other charges save for any addition running costs pertaining to the substitute Equipment. Such substitution shall not entitle you to any refund and does not constitute a breach of this Agreement.

 

11. Release and Indemnity of SOS broadband

 

a. Subject to its obligation to deliver the Equipment or an appropriate substitute Equipment, you release SOS broadband , its employees and agents, from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of this Agreement, including but not limited to: any loss or damage caused by breakdown, mechanical defect, accident or the Equipment being unsuitable for your purpose;

 

b. You hereby indemnify and shall keep indemnified SOS broadband , its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of your use and/or possession of the Equipment

 

12. Title to Equipment

 

You acknowledge that SOS broadband retains title to the Equipment and that you possess the goods as a mere bailee only. You do not have any right to pledge SOS broadband 's credit in connection with the Equipment and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Equipment.

 

13. Changes

 

Any changes to this agreement must be made in writing.

 

14. Proper Law

 

This agreement shall be governed by the law of Great Britain.

 

 

SOS Broadband Fair Usage policy

 

SOS broadband reserves the right to restrict usage of its service or impose charges of excessive usage if it deems the service to be unfairly used including but not limited to the following situations.
